The bodies of Palestinians were handed back mutilated. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">The treatment of the deceased is at least partially covered by international law, and mutilation of corpses – which includes the non-consensual harvesting of organs – is a clear violation.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In armed conflict, the Fourth Geneva Convention states that all parties must take all possible measures to prevent the dead from being despoiled and mutilation of dead bodies is prohibited. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">The UN principles regarding extra-legal, arbitrary or summary executions require the bodies of deceased persons be preserved and protected for investigation, while the \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.ohchr.org\u002Fen\u002Fspecial-procedures\u002Fsr-executions\u002Fminnesota-protocol\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">UN’s Minnesota Protocol\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> requires special care and attention in the recovery and handling of human remains. \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.ohchr.org\u002Fen\u002Fcalls-for-input\u002F2024\u002Fcall-input-protection-dead-persons-and-their-human-remains-including-victims\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">According to the Human Rights Committee\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, disrespectful treatment of human remains may also amount to cruel, inhuman or degrading treatment of the deceased’s family. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In November 2023, two months into Israel’s genocidal war on Gaza, the Euro-Med Human Rights Monitor \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Feuromedmonitor.org\u002Fen\u002Farticle\u002F5982\u002FInt%E2%80%99l-committee-must-investigate-Israel%E2%80%99s-holding-of-dead-bodies-in-Gaza%E2%80%8B\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">tracked the IDF’s confiscation of dozens of dead bodies\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> from the al-Shifa medical complex, the Indonesian hospital in the north of Gaza and others from around Salah al-Din Road – including by \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Freliefweb.int\u002Freport\u002Foccupied-palestinian-territory\u002Fintl-committee-must-investigate-israels-holding-dead-bodies-gaza-enar\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">digging up mass graves\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">. Some bodies were handed over to the ICRC but many, Euro-Med Monitor said, were kept by the Israeli army. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">According to the rights group, medical professionals in Gaza who examined some of the bodies after they were released found evidence of organ theft including “missing cochleas and corneas as well as other vital organs like livers, kidneys and hearts”. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">While doctors said it was impossible for them to conduct full analytical examinations of the bodies due to being under fire by the IDF and dealing with an influx of wounded civilians, they still detected “several signs of possible organ theft by the Israeli military”.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In January 2024, \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.youtube.com\u002Fwatch?v=RfFEkxvAhiE&t=2s\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">CNN reported\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> IDF attacks on 16 cemeteries in Gaza and in the same month, \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Feuromedmonitor.org\u002Fen\u002Farticle\u002F6083\u002FIsraeli-army-defiles-hundreds-of-graves-in-the-Gaza-Strip,-steals-dead-bodies\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">Euro-Med Monitor \u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">stated that at least 12 cemeteries had been targeted by the IDF, deliberately bulldozing and desecrating hundreds of graves, and stealing and dismembering bodies. This followed \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.nytimes.com\u002F2023\u002F12\u002F14\u002Fworld\u002Fmiddleeast\u002Fgaza-cemeteries-damage-israel.html\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">a New York Times report\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> on the IDF razing Gaza’s cemeteries without military justification – which \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.ejiltalk.org\u002Fno-peace-for-the-dead-legal-questions-about-israels-destruction-of-cemeteries-in-gaza\u002F\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">constitutes a war crime\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">January 2024 also saw at least 100 Palestinian bodies buried in a mass grave in Rafah after the IDF took them from hospitals and cemeteries in Gaza. Medical sources said that upon inspection, \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.aljazeera.com\u002Fnews\u002Fliveblog\u002F2024\u002F1\u002F30\u002Fisraels-war-on-gaza-live-israeli-forces-detain-dozens-in-un-shelter-raid?update=2661375\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">some bodies had organs missing\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In April 2024, the desecration of Palestinian bodies was highlighted again, this time in a \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.aljazeera.com\u002Fnews\u002Fliveblog\u002F2024\u002F4\u002F30\u002Fisraels-war-on-gaza-live-34-killed-in-gaza-amid-ceasefire-negotiations?update=2869764\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">statement from the Gaza Ministry of Religious Affairs\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> accusing the IDF of mass corpse mutilation including carrying out postmortem decapitations and dismemberment. It described the IDF throwing bodies into a large pit and covering them in garbage, and said this practice was “documented in al-Shifa medical complex, Nasser medical complex and Kamal Adwan hospital”. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Ch3>The Forensic Institute scandal.\u003C\u002Fh3>\n\u003Cp>\u003Ca href=\"https:\u002F\u002Fwww.theguardian.com\u002Fworld\u002F2009\u002Fdec\u002F21\u002Fisraeli-pathologists-harvested-organs\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">Israeli government officials have admitted\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> that Israel harvested the skin, corneas, heart valves and bones of Palestinians, Israelis and foreign workers in the 1990s – often without permission. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">This shocking admission in 2009 came after state pathologist and director of the Institute of Forensic Medicine in Abu Kabir, Professor Yehuda Hiss, gave an interview to Nancy Scheper-Hughes, a professor of anthropology at the University of California-Berkeley, in 2000. Scheper-Hughes had helped to found\u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fvcresearch.berkeley.edu\u002Fnews\u002Faward-recognizes-impact-anthropologists-work-human-organs-trade\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\"> the Berkeley Organs Watch project\u003C\u002Fspan>\u003C\u002Fa> a year previously.\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In the interview, Hiss was open about organ harvesting on behalf of the Israeli state, saying: “We started to harvest corneas .. whatever was done was highly informal. No permission was asked from the family.”\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">The Israeli organ harvesting story was picked up by \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.aftonbladet.se\u002Fkultur\u002Fa\u002FRx1n5A\u002Four-sons-are-plundered-of-their-organs\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">Swedish newspaper Aftonbladet\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, which included allegations of young Palestinian men disappearing from villages in Gaza and the West Bank – particularly highlighting the case of \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.mizanonline.ir\u002Fen\u002Fnews\u002F2840\u002Fthe-dark-trade-beneath-occupation-evidence-mounts-of-israeli-organ-theft-from-palestinians\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">Bilal Ahmad Ghanem\u003C\u002Fspan>\u003C\u002Fa> who was\u003Cspan style=\"font-weight: 400;\"> killed by Israeli soldiers in 1992. Writer Donald Boström described “meeting parents who told of how their sons had been deprived of organs before being killed” and the bodies of young men being returned by the IDF for burial with slits from the abdomen to the chin. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Boström reported that relatives of the young men told him: “Our sons are used as involuntary organ donors.” \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">The Aftonbladet article linked the alleged theft of young Palestinian men’s organs to \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.thelancet.com\u002Fjournals\u002Flancet\u002Farticle\u002FPIIS0140-6736(09)61665-2\u002Fabstract\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">Israel’s historic shortage of organ donors\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> – and the \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.timesofisrael.com\u002Fkazakhstan-holds-doctor-over-israel-linked-organ-harvesting-scheme\u002F\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">well-documented role of Israelis\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> in the global illegal organ trade. In 2003, an \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fpmc.ncbi.nlm.nih.gov\u002Farticles\u002FPMC487760\u002F\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">international organ trafficking network \u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">was uncovered by police in South Africa, with Israelis as the beneficiaries of illegal transplants. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In the media firestorm that followed, Boström was accused of antisemitism and \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.adl.org\u002Fresources\u002Farticle\u002Funfounded-claims-organ-harvesting-reignite-embers-decades-old-hospital-scandal\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">“blood libel”\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In response, Scheper-Hughes decided to publish the transcript of her 2000 interview with Hiss in \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.counterpunch.org\u002F2010\u002F10\u002F25\u002Fbody-parts-and-bio-piracy\u002F\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">CounterPunch magazine\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, showing that Hiss readily admitted to the non-consensual tissue, skin, bone and organ harvesting to serve the needs of the state of Israel. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">When tape of Scheper-Hughes’ interview with Hiss was released to Israel’s TV Channel 2, the Israeli military said: “This activity ended a decade ago and does not happen any longer.”\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Hiss also admitted in court to performing a second autopsy on American activist Rachel Corrie – who was \u003Ca href=\"https:\u002F\u002Frachelcorriefoundation.org\u002Frachel\" target=\"_blank\" rel=\"noopener\">killed by an Israeli bulldozer in 2003\u003C\u002Fa> – and keeping tissue and organs from her body. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Hiss’s protegee Dr Chen Kugel – who ended up whistleblowing on the Forensic Institute – also \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.counterpunch.org\u002F2010\u002F10\u002F25\u002Fbody-parts-and-bio-piracy\u002F\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">told Scheper-Hughes\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> that although organs and tissues were in theory taken from everyone, in practice it was easier to steal organs from the occupied Palestinian population. Kugel said: “If there were any complaints coming from [Palestinian] families, they were the enemy and so, of course, they were lying and no one would believe them.”\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Parliamentary hearings were held in Israel’s Knesset in December 2009 where health officials testified that Israeli authorities had stolen the organs of dead Palestinians and Israelis a decade previously for transplant purposes. However, \u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\">Palestinian-Israeli politician\u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\"> Ahmed Tibi testified in the Knesset that organ theft had continued, citing \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.aljazeera.com\u002Fnews\u002F2009\u002F12\u002F23\u002Fisrael-opens-organ-theft-hearing\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">the case of Fadul Ordul Shaheen\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\">, a Palestinian from Gaza who died of diabetes in 2009. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">“When his body was given back to his family, his eyes were bleeding and there was a deep cut through his body,” Tibi said. “The family is saying that both the corneas and the kidneys were taken. I am asking you if you’re willing to look into this complaint and see if this activity is continuing, if organs are being harvested from Palestinian prisoners.”\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Israel’s deputy health minister at the time, Yaacov Litzman, said the case would be investigated “with all seriousness”. Novara Media could find no available information about the outcome of an investigation or if one had taken place. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Allegations of Israeli organ theft stretch back even further, to the First Intifada which began in 1987. Another former Forensic Institute employee, Meira Weiss, wrote in her 2014 book Over Their Dead Bodies\u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fmondoweiss.net\u002F2025\u002F02\u002Fa-brief-history-of-israels-theft-and-trafficking-of-palestinian-organs\u002F\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\"> that the IDF\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> “allowed [the Institute] to harvest organs from Palestinians using a military regulation that an autopsy must be conducted on every killed Palestinian. Autopsies were accompanied with organ harvest.” \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Weiss also stated that many Forensic Institute workers “referred to the First Intifada as the ‘good days’, when organ harvesting was conducted consistently and freely compared to other periods”. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Ch3>A legal framework.\u003C\u002Fh3>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">Israel has a long history of \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fjacobin.com\u002F2023\u002F11\u002Fisrael-palestine-gaza-corpse-politics-human-rights-mourning\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">holding onto Palestinian corpses\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> and even passed a law to ensure the state can keep the bodies of Palestinians from bereaved families. \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.jlac.ps\u002Fen\u002FArticle\u002F888\u002FThe-Warmth-of-our-Sons\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">It is the only country in the world besides Russia\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> to have primary legislation that explicitly permits withholding of bodies as part of a wider counterinsurgency programme. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In March 2018, the \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.adalah.org\u002Fen\u002Fcontent\u002Fview\u002F9430\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">Israeli parliament approved a law\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> that allows the Israeli police to hold the bodies of Palestinians killed by the police or other security forces until families agree to preconditions on funeral arrangements.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">This came after the Israeli High Court of Justice decided that while “there are a number of fundamental rights at stake, first and foremost human dignity” involved in the withholding of human remains, the state could explicitly legislate to authorise the violation of fundamental rights. The Knesset summarily did so. \u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">At the time, Adalah – the Legal Center for Arab Minority Rights in Israel – and the Commission of Detainees’ and Ex-Detainees’ Affairs \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.alhaq.org\u002Fadvocacy\u002F15175.html\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">noted that the court’s decision\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> “makes Israel’s ongoing violence of international humanitarian law possible”. \u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\">They said while international law prohibits an occupying power from using bodies as “bargaining chips”, the court’s decision gives “a green light to the grave violation of the right of the families and the deceased themselves to a prompt and proper burial”.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">In December 2024,\u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.aa.com.tr\u002Fen\u002Fmiddle-east\u002Fisrael-s-parliament-advances-bill-on-withholding-return-of-bodies-of-palestinians-to-their-families\u002F3422160\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\"> the Knesset approved the preliminary reading\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> of a bill that would prohibit the return of Palestinian bodies to their families if they were killed while attacking an Israeli. They would receive a mandated ‘burial’ in Israel’s infamous ‘Cemeteries of Numbers’-  where \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.cbc.ca\u002Fplayer\u002Fplay\u002Fvideo\u002F9.6949677\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">hundreds of Palestinian bodies\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> are stockpiled in mass graves marked with numbers rather than names.\u003C\u002Fspan>\u003C\u002Fp>\n\u003Cp>\u003Cspan style=\"font-weight: 400;\">The return of Palestinian remains as part of the ceasefire deal has reignited interest in Israel’s treatment of Palestinians in death, but it is not a new phenomenon. \u003C\u002Fspan>\u003Cspan style=\"font-weight: 400;\">Israel has held onto the remains of Palestinians \u003C\u002Fspan>\u003Ca href=\"https:\u002F\u002Fwww.aljazeera.com\u002Ffeatures\u002F2017\u002F8\u002F10\u002Fwhy-does-israel-keep-the-bodies-of-palestinians\" target=\"_blank\" rel=\"noopener\">\u003Cspan style=\"font-weight: 400;\">since the 1967 war\u003C\u002Fspan>\u003C\u002Fa>\u003Cspan style=\"font-weight: 400;\"> – some in the ‘Cemeteries of Numbers’.
