Si los Estados hubieran cumplido las órdenes de la Corte Internacional de Justicia, si hubieran adoptado todas las medidas necesarias para prevenir, parar y sancionar el genocidio israelí –tal y como obliga el derecho internacional– hoy no estaríamos ante otra guerra ilegal ni ante una gran crisis internacional.

Si hubieran suspendido "relaciones comerciales y de inversión que contribuyan a la situación en los territorios ocupados palestinos", tal y como solicitó la Corte Internacional de Justicia en julio de 2024, la UE no seguiría siendo el mayor socio comercial de Israel en el mundo ni mantendría sus acuerdos preferenciales con Israel, y el Estado israelí habría sentido presión económica. 

Si hubieran impulsado la suspensión de Israel en la Asamblea General de la ONU -como se hizo con el régimen del apartheid de Sudáfrica– y si hubieran activado en la Asamblea la resolución 377A (United for Peace), diseñada para esquivar los vetos en el Consejo, Israel habría sentido presión diplomática y política. 

Si hubieran suspendido sus relaciones y sancionado los crímenes en enero de 2024, cuando la Corte Internacional ya emitió órdenes cautelares y advirtió del riesgo de genocidio, no estaríamos aquí. 

Como señalaron los integrantes de la Comisión de Investigación asignada por la ONU en septiembre de 2025, a partir de esas órdenes de enero de 2024, "si no antes, los Estados tenían la obligación de prevenir y sancionar", la obligación "de actuar, no solo de usar palabras bonitas, sino de actuar". 

Como señalan los jueces de esa Comisión, eso significa que los países tienen la obligación de "suspender cualquier relación o transacción que contribuya a la ocupación israelí” y a la segregación (hay que recordar que el Estado israelí es el mayor impulsor de la ocupación). También indican que eso supone que los países deben "retirar de sus embajadas en Israel a sus agregados militares y sus oficinas comerciales". 

Hemos llegado hasta aquí porque, como indica la relatora de la ONU en su informe, el genocidio en Gaza es "un crimen colectivo", en el que varios Estados lo facilitaron y al menos 64 contribuyeron de diferentes formas. Muchos lo siguen haciendo hoy, manteniendo sus relaciones comerciales, diplomáticas, económicas e incluso armamentísticas, con adquisición de material militar o con proyectos de cofabricación de armamento.

If states had complied with the orders of the International Court of Justice, if they had adopted all the necessary measures to prevent, stop, and punish the Israeli genocide—as required by international law—we would not be facing another illegal war or a major international crisis today.
 
If they had suspended "trade and investment relations that contribute to the situation in the occupied Palestinian territories," as requested by the International Court of Justice in July 2024, the EU would no longer be Israel's largest trading partner in the world, nor would it maintain its preferential agreements with Israel, and the Israeli state would have felt economic pressure.
 
If they had pushed for Israel's suspension in the UN General Assembly—as was done with the apartheid regime in South Africa—and if they had activated Resolution 377A (United for Peace) in the Assembly, designed to circumvent vetoes in the Security Council, Israel would have felt diplomatic and political pressure.
 
If they had suspended their relations and sanctioned the crimes in January 2024, when the International Court of Justice had already issued precautionary orders and warned of the risk of genocide, we wouldn't be here.
 
As the members of the UN Commission of Inquiry pointed out in September 2025, based on those January 2024 orders, "if not before, States had the obligation to prevent and punish," the obligation "to act, not just to use pretty words, but to act."
 
As the judges of that Commission point out, this means that countries have the obligation to "suspend any relationship or transaction that contributes to the Israeli occupation" and segregation (it must be remembered that the Israeli state is the main instigator of the occupation). They also indicate that this implies that countries must "withdraw their military attachés and trade offices from their embassies in Israel."
 
We have reached this point because, as the UN Special Rapporteur indicates in her report, the genocide in Gaza is "a collective crime," facilitated by several states and contributed to in various ways by at least 64. Many continue to do so today, maintaining their trade, diplomatic, economic, and even arms relations, through the acquisition of military equipment or through weapons co-production projects.
